TERMS AND CONDITIONS

These Terms and Conditions govern access to and use of the Shahid Raja Academy Mobile App, related online educational services, training classes, learning materials and student-support services (collectively, the “Services”).

By purchasing, installing, accessing, logging into or using the Services, you confirm that you have read and accepted these Terms and Conditions.

1. Purpose of the Services

Shahid Raja Academy provides educational and training services primarily designed to help students prepare for Spanish driving theory examinations.

Depending on the course or package purchased, the Services may include:

  • Access to the Shahid Raja Academy Mobile App;
  • Theory questions and practice tests;
  • Translations of learning content;
  • Live or online theory training classes (Permiso B English Only)
  • WhatsApp Community group access.
  • Asking questions sending a screenshot from our App only. Screenshots questions from other resources may not be answered.

Only the services specifically included in the student’s purchased course or package are guaranteed.

2. Personal Student Account

Each student account is personal and intended solely for the student for whom it was created.

Students must not:

  • Share their username or password with another person;
  • Allow another person to use their account;
  • Sell, transfer, lend or otherwise provide their account to another person;
  • Use another student’s account; or
  • Create or facilitate unauthorized access to the services.
  • Must not share mobile device to other family members, friends or to any other person to share the mobile application use.

One payment or registration does not provide access for friends, family members, housemates, colleagues or any other person.

Each person wishing to use the Services must have their own authorized account.

3. Authorized Devices

For security and to prevent unauthorized account sharing, Shahid Raja Academy may restrict an account to a specified number of authorized devices, including one registered mobile device per student account where this restriction is technically implemented.

Students must not attempt to bypass, manipulate or circumvent any device restriction or security measure.

Device Installation and Access

  • The Application will be installed and activated on one Android device only, either an Android mobile phone or Android tablet.
  • The Application is intended exclusively for use on the authorized Android device. Use or installation of the Application on a laptop, desktop computer, or other unsupported device is not permitted.
  • The student is responsible for maintaining access to the device on which the Application has been installed and activated.
  • If the registered device is lost, stolen, damaged, replaced, factory-reset, becomes unusable, or for any other reason the student loses access to the Application, Shahid Raja Academy is not obligated to reinstall, reactivate, transfer, or provide the Application on another device.
  • If the student wishes to use the Application on another device following such an event, a new enrolment and full payment of the applicable fee will be required.
  • The price applicable to the new enrolment will be the current fee at the time of the new purchase, which may differ from and may be higher than the amount originally paid by the student.
  • Payment for the original installation does not create a right to transfer the Application or its access from one device to another.

3.1   Application Access Period and Expiry

  • Access to the Application will be provided for a maximum period of one (1) year from the date on which the Application is first activated for the student.
  • The one-year access period begins on the original activation date and continues continuously for 12 months. The access period cannot be paused, suspended, frozen, extended, restarted or carried forward because of the student has not used the Application for whatever reasons.
  • At the end of the one-year access period, access to the Application will automatically and permanently expire, regardless of how frequently or infrequently the student has used the Application during that period.
  • Periods during which the student does not use the Application or does not attend online classes will still count toward the one-year access period.
  • The access period will not normally be extended because of the student’s circumstances, including:
    • Travelling to or staying in another country;
    • Work or employment commitments;
    • Studies or other educational commitments;
    • Holidays or personal travel;
    • Family or personal commitments;
    • Failure to attend online classes;
    • Choosing to temporarily stop studying; or
    • Otherwise being unavailable or unable to make use of the services for reasons attributable to the student.
  • It is the student’s responsibility to make appropriate use of the Application and available educational services during the applicable access period.
  • Unused time, classes, tests, questions, learning materials or other available resources do not accumulate and cannot be transferred to a future enrolment.
  • Expiry of the access period does not depend on whether the student has completed the course, taken the DGT theory examination, passed the examination or obtained a driving licence.
  • If the student wishes to continue or restart the course after the one-year access period has expired, the student will be required to enroll again as a new enrolment and pay the full fee applicable at that time. (Fee updated on 15 November 2025 = 350 euros including IVA).
  • Course and Application fees may change from time to time. Therefore, the fee for a new enrolment may be different from, and may be higher than, the fee originally paid by the student last time.
  • A new enrolment following expiry will be subject to the Terms and Conditions, course structure, fees and services applicable at the time of the new enrolment.
  • Nothing in this section limits any mandatory rights that a student may have under applicable Spanish or European Union consumer law.

4. App Installation and application file Distribution

Where the Android application is provided directly to a student as a file, and to guide the student with the insgtallation process and steps, we ask student to share their mobile device screen, we can only see the mobile screen and guide verbally to perform a few stepts to complete the installation of the mobile app, during the process all the controls of his/her device are only limited to students, we never have access to student’s device, we can only see the share screen and guide verbally to complete the installation process, that file is provided exclusively for the student’s personal authorized use.

The student must not:

  • Forward the installation file to another person;
  • Upload it to a website, social-media platform, messaging group, forum, cloud-storage service or file-sharing service;
  • Publish or distribute the installation file;
  • Sell or commercially exploit the app;
  • Create unauthorized copies of the app; or
  • Assist another person in obtaining unauthorized access.

Possession of an installation file does not grant ownership of the App or any right to redistribute it.

Application Installation Assistance and Screen Sharing

Where the Android Application is provided directly to a student as an installation file, Shahid Raja Academy may provide assistance to guide the student through the installation and activation process.

  • For installation assistance, the student may be asked to share the screen of their mobile device so that Shahid Raja Academy can view the installation steps and provide verbal instructions.
  • Screen sharing is used solely for the purpose of providing installation or technical guidance relating to the Application.
  • During screen sharing, Shahid Raja Academy does not take control of the student’s device. All taps, selections, settings changes, permissions, passwords and other actions on the device remain under the student’s own control and must be performed by the student.
  • Shahid Raja Academy’s role is limited to viewing the screen shared by the student and verbally guiding the student through the necessary installation steps.
  • Students should not intentionally display passwords, banking information, private messages, photographs or other sensitive personal information while sharing their screen. Where possible, unrelated applications and notifications should be closed before screen sharing begins.
  • Screen sharing does not provide Shahid Raja Academy with general or continuing access to the student’s mobile device, files, applications, accounts or other information stored on the device.
  • Once the installation assistance has been completed or screen sharing has ended, Shahid Raja Academy has no continuing screen-sharing access to the student’s device through that session.
  • The Application installation file provided to the student is supplied exclusively for that student’s personal and authorized use and remains subject to the account, device, copying, sharing and distribution restrictions contained in these Terms and Conditions.

5. Intellectual Property

Unless otherwise stated, the original educational materials and proprietary elements made available through Shahid Raja Academy are owned by, licensed to, or lawfully used by Shahid Raja Academy and are protected by applicable intellectual-property laws.

This may include, where applicable:

  • Explanations;
  • Translations;
  • Teaching materials;
  • Graphics and diagrams;
  • Videos and presentations;
  • Lesson structures;

Students receive a limited, personal, non-exclusive and non-transferable right to use the applicable materials for their own education during their authorized access period.

No ownership rights are transferred to the student.

6. Copying, Recording and Redistribution

Students must not systematically copy, reproduce, download, extract, record, publish, distribute, sell or commercially exploit course or App content.

No student or other person is authorized to record, screen-record, capture, reproduce, download, copy, or redistribute any live online class or pre-recorded class session, whether in whole or in part, without prior written permission from Shahid Raja Academy.

In particular, students must not use screenshots, screen recordings, photographs, copying tools or other methods for the purpose of building or distributing unauthorized copies of the course, question database, explanations or other protected materials.

This restriction does not prevent a student from taking a screenshot of an individual question for the legitimate purpose of sending it privately to Shahid Raja Academy to request educational assistance.

Nothing in these Terms limits rights that cannot lawfully be restricted under applicable law.

7. Reverse Engineering and Security

Students must not attempt to:

  • Reverse engineer, decompile or improperly modify the App;
  • Extract or reproduce its databases;
  • Bypass login, device or security restrictions;
  • Gain unauthorized access to accounts, servers or systems;
  • Manipulate account or subscription information;
  • Use automated systems to extract substantial amounts of content;
  • Interfere with the normal operation of the Services; or
  • Assist another person in carrying out such activities.

8. Student Support

Shahid Raja Academy is committed to helping students understand the educational material provided through the Services.

Question Support and Scope of Educational Assistance

  • Where question-support is included in the student’s course, the standard method of requesting assistance is for the student to send Shahid Raja Academy a screenshot or clear reference to the specific question contained within the Shahid Raja Academy Mobile Application that the student does not understand.
  • Our committed question-support service applies specifically to questions and educational content available within the Shahid Raja Academy Mobile Application.
  • Unless expressly agreed otherwise, Shahid Raja Academy is not obligated to provide explanations for questions obtained from third-party applications, websites, books, social-media platforms, other driving schools, external test providers or other outside resources.
  • Similarly, photographs or screenshots of questions obtained from external sources do not automatically fall within the question-support service included with the student’s course.
  • Shahid Raja Academy is also not obligated, as part of the standard question-support service, to provide complete individual lessons or detailed explanations of an entire topic, subject or chapter merely upon request, unless such teaching has been expressly included within the student’s purchased course or scheduled online classes.
  • Questions asked verbally during a telephone call, through a voice note, WhatsApp message or other communication without reference to a specific question contained within the Shahid Raja Academy Mobile Application are not automatically considered requests under the committed question-support service.

Voluntary Additional Support

Shahid Raja Academy is committed to supporting students and may frequently provide educational assistance beyond the services formally included in the student’s course.

For example, a student may ask for an explanation of an entire topic, chapter, general concept, verbal question or material obtained from another source. Where possible, Shahid Raja Academy may voluntarily agree to provide such additional assistance.

If Shahid Raja Academy responds to such a request with words such as “I will explain it,” “I will try to explain it,” “I will explain it later,” “I will check it,” “I will help you with it,” or similar informal wording, this should normally be understood in the context of this policy as an intention to provide additional voluntary educational assistance when reasonably possible, rather than as a guarantee that the additional assistance forms part of the student’s purchased service or will be provided within a particular timeframe, unless a specific commitment has expressly been agreed otherwise.

The timing and availability of such voluntary additional assistance may depend on teaching schedules, workload, preparation or research required, holidays, other students’ support requirements and other reasonable circumstances.

Consequently, where such assistance falls outside the services included in the student’s purchased course, a delay in providing it—or being unable ultimately to provide it—does not by itself constitute a failure to provide the student’s contracted Application or course services and does not by itself create an automatic entitlement to a full or partial refund.

This provision does not exclude or restrict any contractual or consumer rights that cannot lawfully be excluded under applicable Spanish or European Union law.

Shahid Raja Academy will then provide reasonable educational clarification or explanation relating to that question.

Support is intended to clarify questions and concepts that students encounter during their studies. It does not constitute an unlimited on-demand private tutoring service unless such a service has been expressly included in the student’s purchased package.

9. Additional Topic or Chapter Explanations

Shahid Raja Academy may, at its discretion and where time and circumstances permit, provide students with assistance beyond the normal question-support service.

For example, a teacher may voluntarily:

  • Explain a broader topic;
  • Provide additional examples;
  • Discuss an entire chapter or subject;
  • Prepare supplementary teaching material; or
  • Provide additional individual assistance.

Such additional assistance is intended to support students and improve their understanding, but this is not a commitment at all.

Unless Shahid Raja Academy expressly agrees in writing that a particular additional service forms part of the student’s purchased package, such supplementary assistance is provided on a discretionary and availability-dependent basis and is not guaranteed.

An indication that Shahid Raja Academy intends or will try to provide supplementary assistance does not by itself create a guaranteed response time or convert that assistance into an unlimited private tutoring entitlement, subject always to any express agreement made with the student and applicable law.

A delay in discretionary supplementary assistance does not remove the student’s obligation to continue studying or using the normal support channels available to them.

10. Support Response Times

Shahid Raja Academy aims to respond to legitimate student questions within a reasonable period.

However, unless a specific response time has been expressly included in the student’s purchased service, no particular response time is guaranteed.

Response times may vary because of:

  • The complexity of the question;
  • The amount of research or preparation required;
  • The number of students requiring assistance;
  • Weekends or public holidays;
  • Holidays or vacation periods;
  • Illness or unforeseen circumstances;
  • Technical problems; or
  • Other reasonable operational circumstances.

Students should therefore not assume that support is instantaneous or available continuously 24 hours a day unless their purchased service expressly states otherwise.

11. Online Classes

Where live online classes are included in a student’s course, students are responsible for attending scheduled classes and having an appropriate internet connection, device and software necessary to participate.

Class schedules may occasionally need to be changed because of operational requirements, public holidays, illness, technical problems or other reasonable circumstances.

Where reasonably possible, students will be informed of significant scheduling changes.

Failure by a student to attend a scheduled class does not automatically create an entitlement to a refund.

Any recordings, replacement sessions or additional explanations offered following a missed class are subject to the conditions of the student’s particular course.

12. Student Responsibilities

Students remain responsible for their own study, preparation and examination performance.

Students are expected to:

  • Study the provided materials;
  • Complete appropriate practice questions and tests;
  • Attend applicable classes;
  • Ask for clarification when they do not understand something;
  • Provide sufficient information or a screenshot when requesting question support;
  • Keep their account secure; and
  • Use the services responsibly.

Educational support does not replace the student’s own responsibility to prepare adequately for an official examination.

13. No Guarantee of Passing an Examination

Shahid Raja Academy provides preparation, education, practice and support but cannot guarantee that any individual student will pass an official DGT theory examination or obtain a driving licence.

Examination results depend on many factors, including the student’s preparation, understanding, attendance, study effort and performance during the official examination.

Any references to student success, pass rates or successful previous students should not be interpreted as a guarantee of an individual student’s result.

14. Independent Educational Service

Unless expressly stated otherwise, Shahid Raja Academy and its App are independent educational services and are not official applications or services of the Dirección General de Tráfico (DGT).

References to DGT rules, examinations, traffic regulations, signs or procedures are made for educational purposes.

15. Accuracy of Educational Information

Shahid Raja Academy makes reasonable efforts to provide accurate, useful and up-to-date educational information.

However, traffic regulations, administrative procedures, examination practices and official requirements may change.

Students should follow current applicable law and official instructions issued by the competent authorities. Where there is a conflict between educational material and an applicable official rule or legal requirement, the applicable official rule or legal requirement prevails.

Educational Content Updates, Accuracy and Errors

Shahid Raja Academy makes reasonable efforts to keep the educational content of the Application accurate, relevant and up to date. However, traffic regulations, DGT requirements, examination practices and educational materials may change from time to time.

  • Shahid Raja Academy may update, correct, modify, replace, add or remove educational content whenever reasonably necessary.
  • New questions, explanations, translations or other educational materials may be added to the Application periodically. However, there may be a reasonable delay between a change in regulations, examination content or other relevant information and the corresponding update appearing in the Application.
  • Questions or educational materials that have become outdated may be corrected, updated or removed. Due to the volume of content, technical processes or other reasonable circumstances, there may occasionally be a delay in identifying, updating or removing outdated material.
  • Although reasonable care is taken when preparing and reviewing content, the Application may occasionally contain typographical, spelling, grammatical, translation, formatting or technical errors, as well as an incorrect answer option, explanation or other content error resulting from human error, technical malfunction or an Application-related issue.
  • The existence of an isolated or unintentional error does not necessarily mean that the information has been deliberately presented incorrectly or with the intention of misleading students.
  • Students are encouraged to report any suspected error, outdated question, incorrect translation, incorrect answer, technical problem or other content issue to Shahid Raja Academy as soon as possible, preferably by providing a screenshot of the relevant question or content.
  • Once a potential error is reported or identified, Shahid Raja Academy will make reasonable efforts to review the matter and, where appropriate, correct or update the affected content within a reasonable period.
  • Temporary delays in updating content, isolated human errors or technical malfunctions do not by themselves automatically constitute a failure to provide the entire course or Application service, nor do they by themselves create an automatic entitlement to a full or partial refund.

Nothing in this section is intended to exclude or restrict any statutory rights or remedies available to students under applicable Spanish or European Union consumer law.

16. Access Period

Access to the App and related Services is provided for the period included in the student’s purchased course, subscription or package.

Access Period, Attendance and Extensions After an Unsuccessful Exam

Purchase or enrolment in a course does not provide lifetime access or unlimited access until the student passes the DGT theory examination.

Access to the services provided by Shahid Raja Academy is limited to a maximum period of one (1) year from the applicable activation or enrolment date, subject to these Terms and Conditions. This includes, where applicable:

  • Mobile Application access;
  • online training classes;
  • WhatsApp community/group support;
  • question-support services; and
  • any other educational assistance included in the student’s course.

Eligibility for Continued Support After an Unsuccessful Exam

Shahid Raja Academy may extend the above services for an additional two (2) months after the initial access period where the student has genuinely participated in the course but has not passed the DGT theory examination, provided that all applicable extension requirements have been satisfied.

To qualify for an extension for next two months (Next exam date must be scheduled), the student must:

  • Maintain at least 90% attendance in the online classes applicable to their course;
  • Remain reasonably active and engaged with the course during the original access period;
  • Make reasonable use of the learning and support resources provided;
  • Have appeared for the applicable official theory examination;
  • Provide shahid raja academy with reasonable evidence of the unsuccessful examination result when requested; and
  • Continue preparing for and reappear for the examination during the applicable extension period, where reasonably possible.
  • Must have followed all the mentioned rules.

Further Two-Month Extensions

If the student takes the examination again during an authorized extension period and does not pass, Shahid Raja Academy may extend the applicable support services for a further two (2) months, provided that the student continues to satisfy the applicable attendance, participation and examination requirements.

For each further extension requested following an unsuccessful examination attempt, the student must provide reasonable evidence of the relevant examination result.

These two-month extensions may continue following subsequent unsuccessful examination attempts only while the student continues to satisfy the applicable requirements of this policy and remains eligible for an extension.

An extension is intended to support students who have actively participated in their training and are genuinely continuing their examination preparation. It is not intended to provide indefinite access where a student does not attend classes, does not participate in the course, does not appear for the examination or does not provide the reasonably requested evidence of an unsuccessful result.

Failure to meet the extension requirements means that the student’s access may expire at the end of the applicable access period. Continuing the course after expiry may then require new enrolment and payment of the fee applicable at that time.

Nothing in this section limits any mandatory rights available to students under applicable Spanish or European Union consumer law.

When the applicable access period ends, Shahid Raja Academy may deactivate the student’s account or access to relevant Services.

Any extension of access provided voluntarily does not automatically create an entitlement to further extensions.

17. Technical Availability

Shahid Raja Academy aims to maintain reasonable availability of its digital Services but cannot guarantee uninterrupted or error-free operation at all times.

Temporary interruptions may occur because of:

  • maintenance;
  • software updates;
  • server or hosting problems;
  • internet or telecommunications failures;
  • device incompatibility;
  • third-party service failures;
  • security measures; or
  • circumstances outside Shahid Raja Academy’s reasonable control.

Reasonable maintenance or temporary technical interruption does not automatically constitute permanent failure to provide the Service.

18. App Updates and Compatibility

The App may be updated periodically for educational, technical, security or compatibility reasons.

Students may be required to install an updated version to continue using the App.

Older versions may cease functioning where this is reasonably necessary for security, compatibility, maintenance or proper operation.

Students are responsible for maintaining a reasonably compatible device and internet connection, subject to any compatibility information provided before purchase.

19. Payments

Prices and payment conditions applicable to a student’s course or package are those communicated at the time of purchase.

Students must provide accurate information when making payments and must not use unauthorized payment methods.

Access may be suspended where an agreed payment remains legitimately outstanding, subject to applicable law and the terms of the relevant purchase arrangement.

20. Cancellation, Withdrawal and Refunds

Cancellation, withdrawal and refund rights are governed by the conditions applicable to the student’s purchase and by mandatory Spanish and European Union consumer law where applicable.

Nothing in these Terms removes or restricts a consumer right that cannot legally be excluded.

Where digital content, digital services, online classes or other educational services have already begun or been supplied, any cancellation, withdrawal or refund request will be assessed according to the applicable legal requirements and the circumstances of the purchase.

A student’s dissatisfaction with one individual question, discretionary supplementary explanation or non-essential aspect of the Services does not by itself automatically establish an entitlement to reimbursement of the entire amount paid.

Where applicable law provides a right to correction, continued performance, proportional price reduction, termination or reimbursement, the legally applicable remedy will be respected.

21. Suspension or Termination for Misuse

Shahid Raja Academy may take reasonable measures to protect the Services where there is evidence of serious or repeated misuse.

Depending on the circumstances, this may include warning the student, temporarily restricting access or terminating access.

Examples of serious misuse include:

  • account sharing;
  • unauthorized redistribution of the App;
  • systematic unauthorized copying or distribution of protected content;
  • selling course materials;
  • security circumvention;
  • unauthorized database extraction;
  • fraudulent activity; or
  • deliberate attempts to damage or interfere with the Services.

Any action taken will be subject to applicable law and will be proportionate to the circumstances.

Termination for a serious contractual breach does not affect any mandatory rights available to the student under applicable law.

22. Respectful Use and Communication

Students and Shahid Raja Academy are expected to communicate respectfully.

Threatening, abusive, discriminatory, harassing or seriously disruptive behaviour toward teachers, staff or other students may result in reasonable restrictions on communication channels or other proportionate measures.

This provision does not prevent a student from making a legitimate complaint, requesting a refund, exercising a consumer right, seeking legal advice or contacting an appropriate authority.

23. Account Security

Students are responsible for taking reasonable steps to protect their account credentials.

Students should promptly notify Shahid Raja Academy if they believe that:

  • their password has been compromised;
  • another person has accessed their account;
  • their device has been lost or stolen; or
  • unauthorized use of their account has occurred.

Shahid Raja Academy may temporarily restrict an account where reasonably necessary to investigate suspected unauthorized access.

24. Personal Data and Privacy

Personal data is processed in accordance with applicable data-protection legislation, including the General Data Protection Regulation (GDPR) and applicable Spanish data-protection legislation.

Additional information concerning the categories of personal data processed, purposes and legal bases of processing, retention periods, service providers or recipients, international transfers where applicable, and the exercise of data-protection rights should be provided in the Shahid Raja Academy Privacy Policy.

Where device identifiers or similar technical information are used for account security or device registration, this processing will also be addressed in the applicable privacy information.

25. Limitation of Liability

To the maximum extent permitted by applicable law, Shahid Raja Academy will not be responsible for losses caused exclusively by circumstances outside its reasonable control or by a student’s misuse of the Services.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited, including mandatory consumer protections.

26. Changes to the Services

Shahid Raja Academy may make reasonable changes to the App or Services where necessary for reasons such as:

  • updating educational material;
  • changes in traffic regulations;
  • improving functionality;
  • correcting errors;
  • maintaining security;
  • adapting to technological changes; or
  • complying with legal requirements.

Material changes affecting an ongoing paid service will be handled in accordance with applicable consumer law.

27. Changes to These Terms

These Terms and Conditions may be updated when reasonably necessary because of changes to the Services, technology, business operations or applicable law.

Where a change materially affects students with an ongoing contractual relationship, appropriate information will be provided as required by applicable law.

The version applicable to a particular purchase remains subject to any mandatory contractual and consumer protections.

28. Complaints and Dispute Resolution

Students who experience a problem with the Services are encouraged to contact Shahid Raja Academy first so that the issue can be investigated and, where appropriate, resolved.

Nothing in these Terms prevents a consumer from exercising their statutory rights, seeking independent legal advice, using an applicable consumer-dispute mechanism or bringing a matter before a competent authority or court.

29. Governing Law

These Terms and Conditions are governed by applicable Spanish law.

Where the student qualifies as a consumer, nothing in these Terms deprives the student of mandatory consumer protections that apply under Spanish or European Union law, including mandatory protections that may apply according to the consumer’s place of residence.

30. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent permitted by law.

The remaining provisions will continue to apply where legally possible.

32. Data Protection and Privacy

Shahid Raja Academy respects the privacy of its students and processes personal data in accordance with applicable Spanish and European Union data-protection legislation, including the General Data Protection Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

Personal Data We May Process

For the provision and administration of our services, we may collect and process personal data provided by the student, including, where necessary:

  • full name and contact details;
  • telephone number and email address;
  • NIE, TIE, DNI, passport or other identification information;
  • copies or images of identification documents where reasonably required;
  • information necessary for DGT theory examination procedures;
  • driving licence or examination-related information;
  • information necessary for communication with an authorized driving school or relevant authority;
  • course enrolment and student-account information;
  • payment and transaction information where applicable; and
  • communications and information voluntarily provided by the student in connection with the Services.

Purpose of Processing

Personal data may be processed where reasonably necessary for purposes including:

  • registering and administering the student’s enrolment;
  • providing access to the Mobile Application and educational services;
  • communicating with the student regarding classes, examinations, appointments and support;
  • arranging or assisting with DGT theory examination appointments where this service has been agreed;
  • carrying out necessary administrative procedures connected with the student’s examination;
  • communicating necessary information to an authorized driving school involved in the student’s examination process;
  • providing student support and managing the contractual relationship;
  • processing payments and maintaining appropriate business records; and
  • complying with applicable legal, accounting, tax or regulatory obligations.

Personal data will not be used for purposes incompatible with those for which it was collected unless there is an appropriate legal basis for doing so.

Sharing of Personal Data

Where necessary for the provision of an agreed service, relevant personal data may be disclosed to appropriate third parties, such as:

  • The Dirección General de Tráfico (DGT) or other competent examination or administrative authorities;
  • Service providers reasonably necessary for operating or administering the Services; and
  • Public authorities or other parties where disclosure is required by applicable law.

Only information reasonably necessary for the relevant purpose should be disclosed.

Personal data will not be sold to third parties.

Identification Documents

Where a student provides a copy, photograph or digital version of a TIE, NIE, DNI, passport or other identification document for an examination or administrative procedure, the document must be used only where reasonably necessary for the relevant legitimate purpose and handled with appropriate security and confidentiality.

Students should provide accurate and current documentation where required for the relevant procedure.

Security and Confidentiality

Reasonable technical and organizational measures will be taken to protect personal information against unauthorized access, disclosure, alteration, loss, destruction or misuse.

Access to personal information should be limited to persons who reasonably require it for the provision or administration of the relevant service.

Data Retention

Personal data will be retained only for as long as reasonably necessary for the purposes for which it was collected and for any additional period required by applicable legal, accounting, tax, contractual or regulatory obligations.

Different categories of personal data may therefore be retained for different periods.

When personal data is no longer required and there is no legal basis requiring its continued retention, it will be deleted, anonymized or otherwise securely disposed of as appropriate.

Student’s Data-Protection Rights

Subject to the conditions established by applicable law, students may exercise their data-protection rights, including the right to:

  • Request to access their personal data within one year time from the date of enrollment.
  • Request rectification of inaccurate or incomplete information;
  • Request erasure of their personal data where legally applicable;
  • Request restriction of processing;
  • Object to certain processing activities;
  • Request data portability where applicable; and
  • Withdraw consent where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.

A request to delete personal data does not necessarily require immediate deletion of information that Shahid Raja Academy is legally required or otherwise lawfully entitled to retain.

Students also have the right to lodge a complaint with the competent data-protection supervisory authority, including the Agencia Española de Protección de Datos (AEPD) where applicable.

Student Responsibility

Students are responsible for providing accurate personal information and should notify Shahid Raja Academy if relevant information changes.

Students should not provide identification documents or sensitive personal information through unauthorized channels or to persons who are not authorized to receive them.

Acceptance

By purchasing, installing, accessing or continuing to use the Shahid Raja Academy Mobile App or associated Services, the student acknowledges that they have had an opportunity to read these Terms and Conditions and agrees to comply with them, subject to all mandatory rights available under applicable law.
